“Lance in my Pants” Video Contest
Official Rules
NO PURCHASE NECESSARY TO ENTER OR WIN. VOID WHERE PROHIBITED, TAXED OR RESTRICTED BY LAW.
Eligibility & Participation
Eligibility: Each entrant must be a legal resident of the 50 United States or the District of Columbia and be at least 18 years of age. Each entrant is responsible for obtaining personal releases from each videoed participant prior to submission. Employees of Lance, Mfg. LLC. and its marketing and market research contractors, distributors, affiliates, retailers, subsidiaries, licensees, advertising and promotional agencies, and the immediate family members and or persons living in the same household of each, are not eligible to participate (may not submit a video or vote for videos submitted). Contest is void where prohibited, taxed, or otherwise restricted by law. Contest is subject to all federal, state, and local laws and regulations.
To participate: : Make and submit a video promoting Lance snacks and incorporating the slogan “I got Lance in my Pants”. Submit your video at www.lance.com. The video must be under 2 minutes and must be uploaded in one of the following formats: .mov, .wmv, .mpg, .asf, or .avi. Sponsor may disqualify any video that it believes, in its sole discretion, is offensive, sexual, violent, disparaging of Sponsor or its products, or is otherwise inappropriate for viewing on its website. Qualifying videos will be posted on Lance’s website (www.lance.com) within 1 week of submission. Videos will be judged by the general public. Participation is limited to one video/entry per name/address/email address. Once a video has been confirmed as a winning video, that video will not be eligible to win in any other period. You will be required to provide your name, address, phone #, and email address with your video submission.
The promotional period begins on August 1, 2006 at 12:00 am Eastern Time and ends on December 31, 2006 at 11:59:59 pm Eastern Time. There will be 4 separate Award Periods as follows:
Award Period #1 – All eligible entries/videos received August 1, 2006 (12:00 am ET) – September 30, 2006 (11:59:59 pm ET) will be posted on the Lance website for public voting. All votes received through September 30, 2006 (11:59:59 ET) will be tallied. Tallying and selection of the winners will be completed on or about October 11, 2006.
On October 1, 2006 (12:00 am ET), the voting process will begin anew. Once the 3 winning videos have been selected from Award Period #1, those videos will be removed from the website and will not be eligible for prizes in future periods.
Award Period #2 – All eligible entries/videos received August 1, 2006 (12:00 am ET) – October 31, 2006 (11:59:59 pm ET) will be posted on the Lance website. All votes received October 1, 2006 (12:00 am ET) through October 31, 2006 (11:59:59 am ET) will be tallied. Tallying and selection of the winners will be completed on or about November 10, 2006.
On November 1, 2006 (12:00 am ET), the voting process will begin anew. Once the 3 winning videos have been selected from Award Period #2, those videos will be removed from the website and will not be eligible for prizes in future periods.
Award Period #3 – All eligible entries/videos received August 1, 2006 (12:00 am ET) – November 30, 2006 (11:59:59 pm ET) will be posted on the Lance website. All votes received November 1, 2006 (12:00 am ET) through November 30, 2006 (11:59:59 am ET) will be tallied. Tallying and selection of the winners will be completed on or about December 11, 2006.
On December 1, 2006 (12:00 am ET), the voting process will begin anew. Once the 3 winning videos have been selected from Award Period #3, those videos will be removed from the website and will not be eligible for prizes in future periods.
Award Period #4 – All entries/videos received August 1, 2006 (12:00 am ET) – December 31, 2006 (11:59:59 pm ET) will be posted on the Lance website. All votes received December 1, 2006 (12:00 am ET) through December 31, 2006 (11:59:59 pm ET) will be tallied. Tallying and selection of the winners will be completed on or about January 10, 2007.
The general public will cast their votes and the entry/video with the most votes (per Award Period) will be declared the potential 1st Place Prize winner. The entry/video with the second highest votes will be declared the potential 2nd Place Prize winner and the entry/video with the third highest votes will be declared the potential 3rd Place Prize winner. This is a contest of skill. Whether or not you win a prize depends upon how your video entry compares to other entries in each award period based upon the judging criteria outlined in the rules and applied by the voting public. In the event of a tie, winners will be judged and selected, based on the same judging criteria below, by Coresco, Inc (an independent Judging Agency) whose decisions are final, binding, and irrevocable.
Rights and Obligations
Sponsor is not liable for lost, late, misdirected, mutilated, illegible, incomplete, incorrect or inaccurate video submissions or entry information. All entries become the sole property of Sponsor. Furthermore, Sponsor is not responsible for error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone, computer, hardware or software malfunctions of any kind, or inaccurate transmission of, or failure of sponsor to receive entry information on account of technical problems on the Internet or at any web site or any combination thereof. Sponsor is not responsible for obtaining release agreements from the video participants as this is solely the legal responsibility of the entrant. Entrant may be required to produce on demand said releases. By submitting a video entry, you affirm and represent that you own or have the necessary licenses, rights, consents, and permissions to use and transfer to Sponsor all patent, trademark, trade secret, copyright or other proprietary rights in and to your entry and that you have the written consent, release, and permission of each and every identifiable individual in the video to use that person’s name and/or likeness in the video and to transfer to Sponsor all rights in such video entry. In the event of a dispute, videos will be deemed to be produced by the authorized account holder of the email address submitted at the time of entry. The authorized account holder is the natural person who is assigned to the email address by an Internet access provider, on-line service provider, or other organization that is responsible for assigning email addresses or the domain associated with the submitted email address. Sponsor reserves the right, in its sole discretion, to cancel or suspend this contest should a computer virus, worm, denial attack or other causes, beyond its control, corrupt or impair the administration, security or proper operation of the contest. Any malicious attempt by an individual to deliberately damage any web site or undermine the legitimate operation of the contest is a violation of criminal and civil laws. Should such an attempt be made, Sponsor reserves the right to disqualify any entrant and to prosecute and/or seek damages from any such contestant to the fullest extent permitted by law. By entering this contest, entrants transfer to Sponsor all rights in the entry and video, including the right to copy, edit, broadcast, publish, create derivative works and use, in whole or in part, any entry, including all ideas and any copyrighted or copyrightable materials, in any manner and in any media without further consideration and without limitation. By submitting an entry, you warrant that your entry is your own original work and that no other person or entity has any rights, copyright, privacy, publicity, or otherwise, in the entry, and that your entry does not infringe the rights of any other entity. You further represent that the video submitted in the entry has not been previously displayed publicly or submitted to any other entity for any purpose.
Judging Criteria Videos will be judged by the general public – voters are asked to vote based upon the following criteria:
- Quality of Production/Performance
- Adherence to Subject/Slogan
- Originality/Creativity
- Video Quality
Vote as often as you like. However votes are limited to one per day per name/address/email address. A day is considered 12:00 am ET – 11:59:59 pm ET. Posting of a video on the website by Sponsor indicates that the entry/video has been approved as a valid entry. However, prospective winners must meet acceptable criteria for entry (age requirements, residency, etc) in order to be named an official winner. All criteria will be confirmed by an Independent Judging Agency whose decisions are final and binding on all matters relating to this contest.
Prizes The following prizes will be awarded for each of the 4 contest periods:
1st: One First Place Prize Winner will receive a 3.5'' Portable Media Player. The retail value of the prize is $471.00.
2nd: One Second Place Prize Winner will receive a Canon Mini DV Camcorder Kit. The retail value of the prize is $449.00.
3rd: One Third Place Prize Winner will receive a Canon PowerShot Digital Elph. The retail value of the prize is $399.00.
Total # of prizes to be awarded: 4 First Place Prizes, 4 Second Place Prizes, and 4 Third Place Prizes – total retail value of all prizes: $5,276.00. No cash substitutions or transfers will be permitted. The sponsor reserves the right to substitute a prize of equal, or higher value should the indicated prize become unavailable. Any prize awarded to a minor, will be awarded in the name of a parent or guardian. Winners will be notified by email, telephone, and/or mail.
Prize Acceptance
All federal, state and local laws and rules apply. ALL TAXES ON PRIZES ARE THE RESPONSIBILITY OF THE WINNER. Entry constitutes permission for Sponsor and its agencies to use the winner's name, address and/or likeness for purposes of advertising and trade without further consent or compensation, unless prohibited by law. By participating in this contest, entrants agree to be bound by these Official Rules and the decisions of the Sponsor and its agencies. The winner agrees to release and hold harmless the Sponsor and its officers, directors, employees, contractors and agents from loss, injury, death or other liability that may arise from participation in this contest or from acceptance or use of any prize. In order to claim a prize, winners must sign and return an Affidavit of Eligibility and liability/publicity release, unless prohibited, within 10 days of notification date or prize will be forfeited and awarded the entry with the next highest number of votes. Any prize or prize notification returned as undeliverable will not be awarded.
Winners List
The name and city of residence of the prize winners may be obtained by sending a self –addressed, stamped envelope to “Lance in my Pants Winners List”, 1407 Airport Road, Suite 2663, Monroe, NC 28110. Requests must be received by December 31, 2006. Allow six to eight weeks after December 31, 2006 for delivery of list. Winning videos will be posted on the Lance website (www.Lance.com).
